Professional Liability & Negligence Claims

Service overview: Professional negligence claims solicitors

  • The commercial fallout from negligent professional advice can devastate a company – no matter what size the business is or the industry sector it operates in.
  • A properly managed professional liability claim can help undo the commercial damage inflicted on a business that’s been let down by negligent professional advice.
  • Our specialist team of litigation solicitors handles complex, high-value professional negligence claims for businesses, including claims against financial advisors, insurance companies and other professionals.
  • In today’s business environment lots of commercial decisions are taken with professional advice. When you invest in professional advice you should be able to rely on it being dispensed with reasonable skill and care. If it falls short and you suffer loss as a result you may have a professional negligence claim.
  • We act for enterprises large and small across key sectors ranging from the creative industries to the energy, manufacturing and engineering sectors. In addition to professional negligence we handle most types of commercial disputes of varying complexity and value.
  • Deciding on the right strategy for your professional liability claim is crucial. Part of our skill as a team is being able to assess your case and decide whether to negotiate a settlement or embark on full-scale litigation.

What we do: Solicitors for professional liability and negligence claims

In professional negligence cases we’ll weigh up the potential cost to a business of establishing a case against how that business can best achieve its desired outcome.

Many legal claims that arise from negligent advice must follow the steps set out in the professional negligence pre-action protocol. During this initial stage of your case we will explore all alternative dispute resolution (ADR) options.

Professional liability claims have strict limitation periods (the time within which legally you can bring a claim). The exact period will depend on whether your claim is for breach of contract or whether it’s a claim in tort (for negligence). Either way it’s critical to get advice as soon as you think you may have incurred loss or damage as a result of poor professional advice. If you try to bring a claim beyond the limitation period it’s possible that your claim could be disallowed.

Our professional liability team works with businesses that have received negligent professional advice, including advice from:

  • Lawyers, including barristers and solicitors
  • Financial advisors
  • Actuaries
  • Insurance companies
  • Accountants
  • Engineers

It’s our job to nail down the elements of your case before attempting ADR or embarking on litigation. We will need to show not just that you received advice that was negligent but also that the nature of the advice constituted a breach of duty on the part of the advisor. This could be a breach of a duty of care, a breach of a fiduciary duty, a beach of a statutory duty or misrepresentation.

We must also be able to demonstrate that you suffered direct financial loss as a result of the negligent advice.

Who we help: Businesses that have received negligent advice

We work with companies of all sizes across a range of sectors.  All have been affected in some way by poor professional advisors in markets such as financial services and insurance. We also act for advisors facing allegations of negligence, particularly in cases involving PPI excesses.

Many of our clients are start-ups in new and evolving industries and successful venture-backed enterprises.

Advisors in the professional sphere such as actuaries, solicitors and those in the financial services industry are usually required by law to maintain sufficient insurance cover to meet any potential claims This enables successful claimants to recover financial losses and all or at least a significant proportion of legal costs incurred in bringing a claim.
